surgery to remove shards of glass from his body. A police source said
the boy was arrested for assaulting a 39-year-old man and fell into the
window of the Hookah Spot, a bar in the Bronx. But the mom said her son
mouthed off to a cop who then flung him through the window.
A 14-year-old Bronx boy was critically injured when his head was
slammed through the plate-glass window of a hookah bar while handcuffed
and in NYPD custody, his mother told the Daily News.
Javier Payne, an eighth-grader at Middle School 22 with no prior arrest
record, suffered massive blood loss and underwent emergency surgery to
remove shards of glass from his lungs, chest and heart, his mother
Cherita Payne said Wednesday.
“He thought he was going to die,” Payne said. “He said he felt the
blood rushing out of him. He had never felt anything like that before.”
The youth has been in the intensive care unit of Jacobi Medical Center since the Saturday night incident.
A police source said Javier was arrested for assaulting a 39-year-old
man he had asked for a cigarette, and was pulling away from a sergeant
when he “fell” into the window of Hookah Spot on Arthur Ave. in Belmont.
The account of the fall through the window is based on a statement from
Javier’s 13-year-old pal, who was also arrested for the assault, the
source said.
There is no excuse whatsoever for a police officer to smash a 14-year-old boy’s head through a plate-glass window.
But Cherita Payne said her son told her he was flung into the window by
a cop after he was told to shut up and mouthed off to the cop.
“He said, ‘I can talk if I want to,’ and the cop threw him through the window,” she said.
“He only weighs 89 pounds,” Payne said of her son. “I don’t think they should have used force like that.”
The family’s lawyer, Sanford Rubenstein, called on the Bronx district
attorney’s office to open a criminal investigation into the conduct of
the cops.
“There is no excuse whatsoever for a police officer to smash a
14-year-old boy’s head through a plate-glass window,” Rubenstein said
Wednesday.
Investigators from the NYPD Internal Affairs Bureau questioned the boy
Sunday, recorded his statement and showed him an array of photos of cops
for identification.
Cherita Payne also complained that the boy’s feet and wrist have been
shackled to the bed in the hospital room for days. The cop guarding the
teen prisoner told her it was “police protocol,” she said.
The NYPD declined to comment on the incident.
Javier and his friend also are charged with obstructing government administration and resisting arrest.
